Employer of record in Belgium: costs, notice and rules

We may earn a commission when you sign up through some links on this page. Commissions never change our scores or the order of our lists. How we make money.

The confirmed portion of Belgium's employer social security cost is 24.92% of gross pay, the basic ONSS (National Social Security Office) rate for private-sector employers; wage moderation, the 0.40% annual-holidays supplement and other special contributions come on top and are not yet in our figure. The provider's fee is separate: from $199 a month (Payoneer Workforce Management, formerly Skuad) to $699 (Oyster), as read on October 16, 2026. The rule to plan around is that Belgium has had no probation period for ordinary employment contracts since January 1, 2014, so ending a contract early still runs through the statutory notice table.

An employer of record in Belgium is a Belgian employer that hires your worker, declares them to the ONSS, pays employer social security and applies Belgian notice rules, while you lead the work.

Belgium: no trial period, notice by seniority

Belgium's single status law of 2013 abolished probation clauses for contracts starting on or after January 1, 2014. The exceptions are student, temporary and temporary-agency contracts. Instead, employer notice is set in weeks by length of service, per the FPS Employment table:

Belgium: employer notice for contracts since January 1, 2014
SeniorityNotice
Under 3 months1 week
6 to 9 months6 weeks
12 to 15 months8 weeks
2 to 3 years12 weeks

16 years51 weeks
17 years or more (from June 1, 2026)52 weeks (cap)

Source: FPS Employment notice table, checked Oct 2026. Selected rows; the full table is in the rules section below.

Two 2026 changes: notice is capped at 52 weeks from 17 years of seniority from June 1, 2026, and for contracts starting on or after August 1, 2026 notice is 1 week for the whole first 6 months (GrenzInfoPunkt, a cross-border information service).

Pay rules to know: the guaranteed minimum monthly income (GGMMI) is EUR 2,233.61 gross from August 1, 2026 (GrenzInfoPunkt), tested against total pay including any year-end bonus, and sector joint committees often set higher scales. Full-time staff get 4 weeks of leave a year, and there are 10 national public holidays (EURES, the European Commission's jobs portal, a secondary source). We have not confirmed double holiday pay or sector year-end bonuses from an official source; ask your EOR which joint committee your hire falls under.

Belgium cost breakdown on EUR 35,546

Our Belgian example is paid EUR 35,546 a year (EUR 2,962.17 a month), what USD 40,000 bought at the ECB's October 16, 2026 rate of 1.1253.

Belgium: confirmed portion of the employer cost on EUR 35,546 through an EOR
LinePer monthPer year
Gross salaryEUR 2,962.17EUR 35,546.00
Basic ONSS employer contribution, 24.92%EUR 738.17EUR 8,858.06
EOR fee at $599EUR 532.30EUR 6,387.63
Confirmed portion plus EOR feeEUR 4,232.64EUR 50,791.69

Rate: ONSS DmfA contribution instructions. Fee: $599 (Deel, Remote) in euros at 1.1253. Checked Oct 2026.

The basic contribution is 0.2492 times EUR 35,546, or EUR 8,858.06; a year of fees, $7,188, is EUR 6,387.63. Belgium has no ceiling on social security contributions, so the rate applies to all pay. Not yet included: wage moderation, the 0.40% supplement for workers under the annual holidays law (not for categories 1 and 3), other special ONSS contributions, and any sector costs set by the joint committee. The real total is higher than this table.

Sources disagree on wage moderation. The ONSS instructions treat 24.92% as the basic rate and list wage moderation separately: 5.67% of pay plus 5.67% of employer contributions, or 4.27% for structural-reduction categories 1 and 3. Our research also notes a commonly published all-in rate of about 25% for category 1 employers including moderation, which we could not trace to an official table. We show the confirmed 24.92% only; ask your EOR which category its entity uses and what it bills.

Notice is the hidden cost. After 5 years, 18 weeks of notice on EUR 683.58 a week (35,546 / 52) is EUR 12,304.38 in salary, before contributions.

Belgian notice periods grow every year of service, and Multiplier's deposit is calculated partly from notice, so expect a larger one for a senior hire. On the service side, an Oyster customer wrote on Trustpilot in February 2026 that benefits documents for a Belgian employee took almost a month to arrive. Scoring is explained in our method; read the full EOR comparison and the Oyster, Remote and Deel reviews for exit clauses.

Belgian entity versus EOR

A Belgian company of your own would register with the ONSS, file DmfA declarations and join the right joint committee. Six EOR hires at $599 cost $43,128 a year in fees; our entity or EOR guide helps you price the alternative.

Freelancers in Belgium

A Belgian independent (zelfstandige or indépendant) covers their own social contributions, which removes the 24.92%. Work done under your authority, on your schedule, looks like employment, and then both the missed ONSS contributions and the notice table apply. See contractor management tools for real freelance work, or a contractor of record. The country cost index compares Belgium with the Netherlands, France and Luxembourg.
